These Terms govern your use of Zypaway, operated by KD SHARK INDUSTRIES PVT LTD ("we", "us"), available at zypaway.com.au (full edition) and zypaway.com (global edition). By using Zypaway you agree to these Terms.
Zypaway lets you design animated event invitations, share them by link or QR code, collect RSVPs, and gather photos from guests into an album. Features and limits depend on the plan you choose.
You are responsible for your account and for keeping your sign-in details secure. You must provide accurate information and be old enough to form a binding contract. You're responsible for activity under your account.
Paid plans and add-ons (top-ups) are one-time purchases processed by Stripe. All prices are in Australian Dollars (AUD) unless stated otherwise. We do not store your card details. Because purchases unlock digital features immediately, they are generally non-refundable except where required by the Australian Consumer Law.
You keep all rights to the photos and content you and your guests upload. To run the service, you grant Zypaway a limited, non-exclusive licence to host, store, reproduce and display that content solely to render and deliver your invitation and its features. Zypaway's own software, designs, themes and branding remain our property.
As an invitation owner, you control your event album and can remove RSVPs or photos. You are responsible for moderating content guests submit through your link.
We aim to keep Zypaway available and reliable but provide it on an "as is" and "as available" basis. We don't guarantee uninterrupted or error-free operation and may change, suspend or discontinue features.
To the maximum extent permitted by law, Zypaway is not liable for indirect, incidental or consequential loss, or for loss of data, content or profits. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
You may stop using Zypaway at any time and request deletion of your data. We may suspend or terminate access for breach of these Terms.
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
